UPDATE!! Effect Of The New UK Immigration Law For Those on Student Visa Tier 4
Information On The UKVI website shows that imminent changes for the Care and senior care sponsorships visa will be made early 2024 those changes include:
- Care workers (SOC[2] code 6145) and senior care workers (SOC code 6146) already in the route will be able to remain with their dependants, including extending, changing employer (within these SOC codes) and settlement.
- Where a care worker or senior care worker is in the route before the Immigration Rules change, but has not yet brought dependants, they will be allowed to bring dependants during their sponsorship (on this visa).
Individuals who are in the UK on any other route, including where that route permits dependants, who switch into the care visa as a care worker or senior care worker after this date, will not be able to stay with (or bring over) dependants. - Care providers who were sponsoring workers in exclusively non-regulated activities (and therefore not required to be registered with the CQC) before the rules change should be able to continue to sponsor these workers, including for extensions to their vis those terms, but not hire new ones.
It simply means:
1. If you are already on a sponsorship visa, and already in the UK before April 2024 then you can continue on that route to settlement yourself and your dependent
2. From April, if you're on a study route, you will not be able to bring a new dependant or even switch with one if you switch to a care visa.
3. From Spring, (April-May) your cannot add a dependent to your sponsorship visa even if both of you are already in the UK.
For those on student visa that has plans to switch as dependent to their partner who has gotten a certificate of sponsorship (COS). This will not be possible anymore
These are some of the Reviews for the Graduate Visa Route as promised by the Home Secretary.
Alternate Solution:
1. Get a Certificate Of Sponsorship and switch before the start of the policy.
2. Get a post-study visa, use it to buy time and travel to another country with a more stable settlement process before the expiration of your Post Study Work Visa
3. You and your Partner should look for COS separately. (Don't know about kids tho).
